Summary

The Unfair Competition Prevention and Trade Secret Protection Act of Korea, enacted to maintain orderly trade, aims to prevent unfair competition and protect trade secrets. The Act prohibits improper use of well-known trademarks and trade names, misleading marks about goods' origins, and unauthorized uses of another's technical or business ideas. It also addresses the misuse of data with economic value generated from substantial efforts or investments. The Act defines trade secrets as protected confidential business information and sets guidelines for their proper use and protection against unauthorized acquisition or disclosure. The Korean Intellectual Property Office (KIPO) is responsible for establishing basic and action plans every five years and annually, respectively, to enforce the Act. KIPO conducts fact-finding surveys and can call for cooperation from public institutions. Additionally, KIPO engages in research, education, and public relations to support the Act’s objectives.
