Korean Court Sanctions Unauthorized Reuse and Editing of Broadcast News Footage
A South Korean court has imposed criminal penalties on a YouTube channel operator for unauthorized reproduction, editing, and redistribution of broadcast news footage. The Busan District Court’s Eastern Branch fined the operator KRW 3 million and ordered the forfeiture of approximately KRW 8.75 million in criminal proceeds, reaffirming that broadcast news videos are protected under copyright law.
The operator had repackaged 64 MBC news videos into approximately one-minute YouTube Shorts between December 2024 and March 2025, adding subtitles while retaining substantially the same content. The case also highlighted concerns over YouTube’s counter-notice procedure, which can create additional legal and financial burdens for copyright holders seeking to prevent unauthorized distribution.
The ruling underscores that the public-interest nature of news reporting does not automatically permit the reuse of copyrighted footage. Simply shortening videos, adding subtitles, or modifying their presentation does not eliminate copyright infringement risks.
The case could have broader implications for online content creators, digital platforms, and broadcasters, particularly as short-form videos and repackaged media content continue to grow.
